Allahabad High Court

SOVIN @ DEVESH AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court disposed of the anticipatory bail application, directing that the petitioners may apply for regular bail within four weeks and that no coercive action be taken against them during that period.

Summary

The petitioners sought anticipatory bail under Section 482 of the Criminal Procedure Code. The court, after hearing counsel, directed that the petitioners may approach the concerned court within four weeks to apply for regular bail under several sections of the B.N.S. Act, and that their bail applications be disposed of expeditiously without being influenced by the earlier rejection of anticipatory bail. The court also ordered that no coercive action be taken against the petitioners for a period of four weeks. The learned Additional Government Advocate raised no objection to the prayer. Consequently, the anticipatory bail application was disposed of with the above directions.

Issues considered

  • Whether the anticipatory bail application under Section 482 CrPC should be granted or dismissed.
  • Whether the petitioners can be permitted to apply for regular bail pending the outcome of the anticipatory bail application.
  • Whether coercive action can be stayed against the petitioners during the interim period.
