Allahabad High Court

SALAUDDINversusSTATE OF U.P.

Decided

Holding

The court dismissed the anticipatory bail application as withdrawn, permitting the applicant to re‑file after satisfying the disclosure requirement.

Summary

Salauddin applied for anticipatory bail under Section 482 of the Criminal Procedure Code. The learned Additional Government Advocate objected, stating that the applicant had not disclosed his criminal antecedents as required by Chapter XVIII, Rule 18(7) of the Court Rules. Counsel for the applicant sought permission to withdraw the application and re‑file it with the necessary disclosure. The court accepted this request, dismissed the present application as withdrawn, and granted liberty to file a fresh application complying with the rule. Certified copies of the order were to be returned to the applicant’s counsel.

Issues considered

  • Whether the failure to disclose criminal antecedents under Rule 18(7) warrants dismissal of an anticipatory bail application.
  • Whether the applicant may be allowed to withdraw the application and re‑file after complying with the procedural requirement.
