Allahabad High Court

JUGENDRA @ CHHOTEversusSTATE OF U.P.

Decided

Holding

The anticipatory bail application is dismissed; the applicant may file a regular bail application within four weeks and no coercive action shall be taken against him during that period.

Summary

The applicant, Jugendra @ Chhote, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in connection with Crime No.168 of 2026. After hearing, the applicant’s counsel sought to withdraw the anticipatory bail application and instead move a regular bail application, requesting protection of his interests in the interim. The Assistant Advocate General did not oppose the withdrawal. The court permitted the withdrawal, directed that the applicant file a regular bail application within four weeks, and ordered that no coercive action be taken against him during that period. Consequently, the anticipatory bail application was dismissed and the matter was disposed of.

Issues considered

  • Whether the anticipatory bail application can be withdrawn and replaced by a regular bail application.
  • Whether the court can order a stay on coercive action pending the regular bail application.
