Allahabad High Court

CHANDRA BHAN YADAVversusSTATE OF U.P.

Decided

Holding

The anticipatory bail application under Section 482 CrPC is dismissed, and the applicant is directed to seek regular bail.

Summary

The applicant, Chandra Bhan Yadav, was charge-sheeted for offences under IPC sections 424, 467, 468 and 471. He had earlier filed an anticipatory bail application under Section 528 of the CrPC (BNSS No.24850 of 2025), which the High Court dismissed, terminating the interim relief previously granted. He subsequently filed another anticipatory bail application under Section 482 of the CrPC (BNSS No.8803 of 2026). The Court observed that the applicant had no apprehension of arrest and could instead apply for regular bail before the trial court. Consequently, the Court ordered that no coercive action be taken against the applicant for four weeks and disposed of the anticipatory bail application, directing the applicant to seek regular bail within that period.

Issues considered

  • Whether an anticipatory bail application under Section 482 CrPC can be entertained after the dismissal of a prior application under Section 528 CrPC when the applicant has no apprehension of arrest.

Court No. - 71
                 HON'BLE RAJIV LOCHAN SHUKLA, J.

1. Heard Learned counsel for the applicant and Learned AGA for the
State.

2. At the outset, learned AGA has pointed out that the applicant has been
charge-sheeted and summoned for offences under Sections 424, 467, 468
and 471 IPC. The applicant had challenged the proceedings before this
court in application under Section 528 BNSS No.24850 of 2025, in which
this Court by means of a detailed order, taking note of the entire
arguments raised by the applicant, was pleased to dismiss the said
application and the interim order that had been granted in favour of the
applicant thereby came to an end. The applicant has no apprehension of
arrest. He may appear before the concerned court and apply for regular
bail, which may be considered and disposed of in accordance with law.

3. Learned counsel for the applicant has raised several legal and factual
submissions which in the opinion of the court cannot be taken note of
after rejection of the application under section 528 BNSS of the applicant.
At present, there does not appear to be any apprehension of arrest and the
applicant can appear before the concerned court and apply for regular
bail. In case the applicant appears before the concerned court within 4
weeks from today and applies for bail, his application may be considered
and disposed of in accordance with law

4. For a period of four weeks from today, no coercive action shall be
