The court directed that the applicant may apply for regular bail within four weeks and ordered a stay on any coercive action during that period.
Summary
The Allahabad High Court heard an anticipatory bail application under Section 482 of the CrPC filed by Pravindra Yadav. The applicant’s counsel requested permission to approach the concerned court for regular bail and sought temporary protection of his interests. The opposing counsel raised no objection. The court directed that the applicant must appear before the concerned court within four weeks to apply for regular bail under various IPC sections, and that his bail application will be considered expeditiously without being influenced by any earlier rejection of the anticipatory bail. Additionally, the court ordered that no coercive action be taken against the applicant for the next four weeks. The anticipatory bail application was consequently disposed of.
Issues considered
- Whether the applicant can be permitted to seek regular bail after an anticipatory bail application.
- Whether the court can stay coercive action pending the regular bail application.
