Allahabad High Court

RAMJANIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The anticipatory bail application is dismissed; the applicant may withdraw it and file a regular bail application within four weeks, with no coercive action to be taken against him.

Summary

The applicant sought anticipatory bail under Section 482 of the Criminal Procedure Code in a case involving offences under Sections 333, 325, 352, 351(2) and 109(1) of the Indian Penal Code. The counsel requested permission to withdraw the anticipatory bail application and instead file a regular bail application before the trial court. The Attorney General’s Office raised no objection. The High Court allowed the withdrawal, directed that the applicant file a regular bail application within four weeks, and ordered that no coercive action be taken against him during that period. The court also ordered that the regular bail application be considered expeditiously, without being influenced by any observations of the trial court. The anticipatory bail application was therefore dismissed and the matter was disposed of.

Issues considered

  • Whether anticipatory bail under Section 482 CrPC should be granted in the present case
  • Whether the applicant may withdraw the anticipatory bail application and seek regular bail
  • Whether the court can direct expeditious consideration of a regular bail application without prejudice to the trial court’s observations
