Allahabad High Court

DHEERAJ CHAMAARversusSTATE OF UP

Decided

Holding

The application was dismissed as withdrawn, permitting the applicant to file a fresh application with the required disclosure.

Summary

The applicant, Dheeraj Chamaar, filed an anticipatory bail application under Section 482 of the CrPC. The Attorney General objected, stating that the application failed to disclose the applicant’s criminal antecedents as mandated by Chapter XVIII, Rule 18(7) of the Court Rules. Counsel for the applicant sought permission to withdraw the present application and file a fresh one with the required disclosure. The Court, considering this request, allowed the withdrawal and dismissed the application with liberty to re‑file. Certified copies of the order were directed to be returned to the applicant’s counsel.
