Allahabad High Court
TEJVEERversusSTATE OF U.P.
- Decided
- Bench
- RAJIV LOCHAN SHUKLA
Holding
The court granted anticipatory bail to the applicant under Section 482 CrPC.
Summary
The applicant, Tejveer, filed an anticipatory bail application under Section 482 of the CrPC in a 2001 case involving multiple IPC offences. He claimed false implication, lack of specific role, and cooperation with the trial, noting his age (61) and no prior convictions despite three pending cases. The State opposed, arguing the applicant and co‑accused had evaded court appearances and were absconders. The court noted that co‑accused Jaiveer Singh and Jagdish @ Sethi had previously been granted anticipatory bail in similar proceedings. Considering the facts, the court deemed it appropriate to grant anticipatory bail to Tejveer, subject to standard conditions and the possibility of cancellation on breach.
Issues considered
- Whether the applicant is entitled to anticipatory bail under Section 482 CrPC despite alleged absconding.
- Whether the applicant's alleged false implication and lack of prior conviction justify bail.
- Whether the existence of non‑bailable warrants affects the grant of anticipatory bail.
