Allahabad High Court

ANUJ KUMAR SINGH YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court disposed of the anticipatory bail application, permitting its withdrawal and directing that no coercive action be taken for four weeks while the applicant seeks regular bail.

Summary

The applicant filed an anticipatory bail application under Section 482 of the Criminal Procedure Code. After hearing, the applicant’s counsel requested to withdraw the anticipatory bail application and instead move a regular bail application in the pending criminal case. The opposing party’s counsel did not object. The court allowed the withdrawal, directing that the applicant appear before the concerned court within four weeks to file a regular bail application and that no coercive action be taken against him during that period. The court ordered that the regular bail application be considered expeditiously and that the anticipatory bail application be dismissed. The application was consequently disposed of.

Issues considered

  • Whether an anticipatory bail application can be withdrawn and the applicant can be permitted to seek regular bail in the pending case
  • Whether the court can impose a condition of no coercive action for a specified period pending regular bail
