Allahabad High Court

SUGAM @ SHUBHAMversusSTATE OF U.P.

Decided

Holding

The Court ordered that no coercive action be taken for four weeks and allowed the applicant to apply for regular bail within that period, thereby disposing of the anticipatory bail application.

Summary

The applicant, Sugam @ Shubham, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in connection with a criminal case (Crime No. 42 of 2004) involving offences under Sections 420, 467, 468 and 471 of the Indian Penal Code. The applicant's counsel requested permission to approach the concerned court for regular bail and sought a short protective order. The Additional Government Advocate raised no objection to the prayer. The High Court directed that the applicant must appear before the concerned court within four weeks to apply for regular bail and that his bail application will be considered expeditiously, without being influenced by the earlier rejection of the anticipatory bail. The Court also ordered that no coercive action be taken against the applicant for a period of four weeks and disposed of the anticipatory bail application.

Issues considered

  • What relief, if any, can be granted in an anticipatory bail application under Section 482 CrPC pending a regular bail application?
  • Whether the court can stay coercive action against the applicant for a specified period pending regular bail.
