Allahabad High Court

VINOD ARORA ALIAS RAVIversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court allowed interim protection, permitting the applicant to apply for regular bail within four weeks and directing that the bail application be decided expeditiously without prejudice from the Sessions Court’s earlier refusal.

Summary

The applicant, Vinod Arora, filed an anticipatory bail application under Sections 340(2), 336(3), 338 and 318(4) of the BNSS, 2023, fearing arrest in a criminal case (Crime No. 249 of 2025). The counsel requested that the applicant be allowed to appear before the trial court and seek regular bail, seeking interim protection. The State’s Additional Government Advocate raised no objection to the prayer. The High Court granted interim protection, directing that the applicant may appear before the concerned court within four weeks and apply for regular bail, which must be decided expeditiously and without being influenced by any earlier refusal of anticipatory bail by the Sessions Court. The court also ordered that no coercive action be taken against the applicant during the four‑week period and disposed of the anticipatory bail application.
