The suspension without disciplinary proceedings was unlawful, but since the petitioner was reinstated, the writ petition was dismissed as infructuous.
Summary
Ramesh Kumar Verma, a government employee, challenged an order dated 27 July 2026 that placed him under suspension without any disciplinary proceedings. He filed a writ petition before the Allahabad High Court seeking relief from the suspension. The Court granted the petitioner two weeks to file a supplementary affidavit and directed the respondents to obtain instructions from the concerned authorities, scheduling a fresh hearing for 28 September 2026. Before the fresh hearing, the respondents informed the Court that the suspension order had been revoked and the petitioner had been reinstated on 18 September 2026. On this basis, the petitioner’s counsel submitted that the writ petition had become infructuous. The Court accordingly dismissed the petition as infructuous on 28 September 2026.
