Allahabad High Court

RAM BAHADUR SINGH AND 2 OTHERSversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The petition is disposed of without merits, with the petitioners directed to file a fresh representation before the Director, who must decide it expeditiously.

Summary

Ram Bahadur Singh and two others filed a writ petition seeking a mandamus directing the State of Uttar Pradesh and other respondents to grant them regular pension benefits with interest and to compel the Director (respondent No.2) to consider a representation dated 27.07.2026. The petitioners alleged that their grievance regarding retiral benefits had not been addressed. The respondents argued that the matter should be dealt with by the Director and did not oppose a direction for speedy disposal of a fresh representation. The Court, finding no merit in continuing the petition, ordered the petitioners to file a fresh representation before the Director within three weeks, attaching a certified copy of the order. The Director was directed to decide the representation within three months, subject to any legal impediment. Consequently, the writ petition was disposed of without any substantive ruling on the merits.

Issues considered

  • What relief, if any, can be granted by the High Court in the form of mandamus directing the State to provide pension benefits?
  • Whether the Court should direct the administrative authority (Director) to consider and decide the petitioners' representation pending before it.

4. Sri Adarsh Bhushan, learned counsel appearing for respondents nos.2 to
5 has contended that the grievance of the present petitioner, as raised in the
instant writ petition, can be more appropriately redressed by the Director,
respondent no.2 and that he has no objection if a direction is issued for
expeditious disposal of the fresh representation, to be moved by the present
petitioner, within such stipulated period, as may be directed by this Court.

5. In this conspectus, as above, no useful purpose would be served by
keeping this matter pending. Therefore, this Court deems it appropriate to
