Allahabad High Court

OMVEER SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The High Court disposed of the writ petition without merits, directing the petitioner to file a fresh representation before the Vice‑Chairman, Meerut Development Authority.

Summary

The petitioner, Omveer Singh, filed a writ petition seeking mandamus directing the State of Uttar Pradesh and other authorities to release his pensionary and other retiral benefits accrued since 1 November 1989 as a work-charge employee. The petition also requested that all service benefits be provided in accordance with law. Respondents argued that the grievance should be addressed by the Vice‑Chairman of the Meerut Development Authority and offered no objection to the petitioner filing a fresh representation before that authority. The High Court found that keeping the petition pending would serve no useful purpose and disposed of it without addressing the merits, directing the petitioner to approach the Vice‑Chairman within three weeks and for the authority to decide the matter within three months. The order thus dismisses the writ petition and remands the issue to the appropriate administrative forum.
