Holding
The High Court disposed of the writ petition, directing the petitioner to move a fresh representation before the Regional Provident Fund Commissioner without expressing any opinion on the merits.
Summary
Mani Ram Verma filed a writ petition seeking mandamus directing the State of U.P. and others to pay his EPF funds, pension, and medical leave benefits, and to decide his representation. The respondents contended that the grievance should be addressed by the Regional Provident Fund Commissioner and did not oppose a court direction for the petitioner to file a fresh representation. The High Court held that keeping the petition pending would serve no useful purpose and disposed of it without addressing the merits. The Court directed the petitioner to file a fresh representation before the Commissioner within three weeks, attaching a certified copy of the order, and instructed the Commissioner to decide the matter within three months. Consequently, the writ petition was dismissed and the petitioner was advised to pursue the remedy through the appropriate administrative forum.
Issues considered
- What is the appropriate forum for redressing the petitioner's grievance regarding non-payment of EPF funds, pension, and medical leave – the High Court via mandamus or the Regional Provident Fund Commissioner?
- Whether the High Court should entertain the writ petition or direct the petitioner to approach the administrative authority.
