NARENDRA KUMARversusASSISTANT LABOUR COMMISSIONER FIROZABAD AND ANOTHER

Decided

Holding

The Court ordered the competent authority to decide the execution application within two months and disposed of the writ petition.

Summary

The petitioner, a workman, obtained a labour award dated 14‑11‑2013 in Adjudication Case No. 53 of 2012, which has become final up to the Supreme Court. He filed an application before the Assistant Labour Commissioner for execution of the award, but no final decision has been rendered despite notice to the Municipal Commissioner, Nagar Nigam, Firozabad. The petitioner filed a writ petition seeking expeditious execution of the award. The respondent Municipal Commissioner raised no objection to a direction for speedy disposal of the execution application. The High Court, without expressing any view on the merits, directed the Additional Labour Commissioner/competent authority to decide the execution application within two months of production of a certified copy of the order and expected full cooperation from the Municipal Commissioner. Accordingly, the writ petition was disposed of.
