Allahabad High Court

RAJESH SINGHversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The court held that the disciplinary authority must conclude the proceedings against the petitioner within six weeks of the order.

Summary

The petitioner, Rajesh Singh, challenged the suspension order dated 14 January 2026 issued by the Director, Cooperative Societies and Panchayat Audit, Government of Uttar Pradesh. The court noted that the charge‑sheet had been served on the petitioner and an enquiry report was filed on 2 February 2026. Having satisfied that procedural steps were underway, the court disposed of the writ petition. It directed the disciplinary authority to complete the disciplinary proceedings against the petitioner as expeditiously as possible, preferably within six weeks of the certified copy of the order. The petitioner was instructed to cooperate with the enquiry.

Issues considered

  • Whether the suspension order is maintainable in the absence of a completed disciplinary enquiry
  • Whether the petitioner was denied due process by the suspension
  • Whether the court can direct a time‑bound conclusion of the disciplinary proceedings

Subjects

  • suspension
  • disciplinary proceedings
