Allahabad High Court

VISHAL SINGHversusTHE STATE OF UP AND 2 OTHERS

Decided

Holding

The petitioner is entitled to interest on the retained amount at 6% per annum.

Summary

Vishal Singh filed a writ petition alleging that the State of Uttar Pradesh illegally retained Rs.6,16,413 of his post‑retiral benefits for about ten months before refunding the amount on 2 May 2026. The petitioner sought interest on the delayed payment, arguing that the retention was unlawful. The court noted that the refund had been made but the period of retention justified interest. It held that the petitioner was entitled to interest at 6% per annum for the time the amount was retained. Accordingly, a mandamus was issued directing the authority to credit the interest to the petitioner’s bank account within three weeks, and the writ petition was allowed.

Issues considered

  • Whether the petitioner is entitled to interest on the amount of Rs.6,16,413 that was retained by the respondents for about ten months.
  • Whether the writ petition becomes infructuous after the refund of the principal amount.
