Holding
The petition is dismissed as infructuous because the relief sought has already been granted.
Summary
Petitioner Mahendra Pal filed a writ petition seeking to quash an order dated 31.03.2026 issued by the Chief Medical Officer, Banda, which had terminated his services. The Court, following its earlier direction, considered an order dated 23.04.2026 wherein the petitioner was reinstated on a contractual basis. The petitioner’s counsel argued that since the reinstatement had already been granted, the relief sought was no longer necessary. The Court examined whether the petition had become infructuous in light of the subsequent reinstatement order. Concluding that the petitioner had obtained the relief he sought, the Court dismissed the writ petition as infructuous.

Court No. - 6
HON'BLE PRAKASH PADIA, J.
1. The petitioner has preferred the present writ petition inter-alia with the
prayer to quash the order dated 31.03.2026 passed by the Chief Medical
Officer, Banda.
2. Pursuant to the order passed by this Court, counsel for the petitioner
placed before this Court an order dated 23.04.2026 passed by the Chief
Medical Officer, Banda by which the petitioner has been reinstated in his
services on contractual basis.
3. In this view of the matter, it is argued by the counsel for the petitioner
that relief sought by the petitioner has already been granted to him,
therefore, no further orders are required to be passed and the present writ
petition may be dismissed as having become infructuous.
4. Accordingly, the writ petition is dismissed as having become
infructuous.
