Allahabad High Court

SANDEEP CHOPRAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is not maintainable as an alternative remedy under the 2020 Regulations is available.

Summary

The petitioner, Sandeep Chopra, challenged his dismissal from service by an order dated 12‑03‑2026 issued by respondent No. 3. The respondents argued that the writ petition was not maintainable because an alternative remedy existed under the Uttar Pradesh Power Corporation Limited Employees (Discipline and Appeal) Regulations, 2020. The petitioner’s counsel did not contest this contention. The Court held that the presence of a specific appeal mechanism under the 2020 Regulations barred the writ petition. Consequently, the petition was dismissed as non‑maintainable.

                                    Court No. - 33
                                                        HON'BLE DINESH PATHAK, J.

                                    1. The petitioner is aggrieved by the order dated 12.03.2026 passed by the
respondent No. 3, whereby he has been dismissed from his service.

                                    2. Learned counsel for the respondents has raised a preliminary objection
with regard to maintainability of the instant writ petition on the ground of
availability of an alternative remedy to file an appeal before the higher
authority under the Uttar Pradesh Power Corporation Limited Employees
                                    (Discipline and Appeal) Regulations, 2020.

                                    3. Learned counsel for the petitioner has not refuted the contention as raised
by the learned Standing Counsel qua availability of an alternative remedy, as
                                    mentioned above.

                                    4. As such, instant writ petition is dismissed, being not maintainable, on the
ground of availability of an alternative remedy to file an appeal before the
                                    appellate authority as mentioned above.
