Allahabad High Court

DINESH KUMAR GAUTAM AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court did not decide the merits but directed the petitioners to file a fresh representation before the recruitment board and the board to decide it expeditiously.

Summary

The petitioners challenged the State of U.P. and others for declaring results only for 930 of the 1,129 Computer Operator Grade‑A posts advertised, leaving 199 positions unfilled. They sought a court order directing the respondents to declare the results for the remaining vacancies. The respondents argued that the petitioners could file a representation before the competent authority, which would then decide the matter. The Court, with the parties' consent, disposed of the writ petition by directing the petitioners to file a fresh representation before the U.P. Police Recruitment and Promotion Board within two weeks, and instructed the Board to decide the representation within four weeks. The Court clarified that it had not adjudicated the merits and left the substantive decision to the Board under the applicable recruitment rules.
