Allahabad High Court

PLATOON COMMANDER GYANENDRA SINGHversusSTATE OF UTTAR PRADESH AND 7 OTHERS

Decided

Holding

The Court held that the writ petition cannot be entertained and the petitioner may move a representation under any future transfer policy, leaving the transfer order undisturbed.

Summary

Platoon Commander Gyanendra Singh filed a writ petition challenging an order of transfer dated 11 March 2025 issued by the Inspector General of Police (Establishment), Uttar Pradesh. The petitioner contended that the transfer was illegal and sought relief from the High Court. The respondents argued that the transfer was a valid administrative action and that the petitioner could raise a representation under any new transfer policy. The Court observed that the petition was not pressed and that the petitioner retained the liberty to move a representation when a new transfer policy is issued, leaving no ground to interfere with the transfer order. Accordingly, the writ petition was dismissed without disturbing the transfer.
