Holding
The Court held that the petitioner must join the transferred post within a week and the competent authority must decide his representation within three weeks, thereby disposing the writ petition.
Summary
The petitioner, Santosh Kumar Singh, challenged an order dated 10.04.2026 issued by the Additional Director General of Police, Varanasi Zone, which rejected his representation and directed him to join his duties at Mirzapur. He sought permission to make a representation before the competent authority (respondent no.4) and to obtain a fresh order. The respondent argued that if the petitioner joined his transferred post within a week, his representation would be considered expeditiously within three weeks. The Court directed the petitioner to join the transferred post within a week and ordered the competent authority to decide his representation within three weeks in accordance with law. Accordingly, the writ petition was disposed with these directions.
Issues considered
- Whether the order rejecting the petitioner's representation and directing immediate transfer violates principles of natural justice.
- Whether the petitioner is entitled to make a representation before the competent authority prior to joining the transferred post.
- Whether the Court can prescribe a timeline for the consideration of the petitioner's representation.
