Allahabad High Court

DR. ANIL KUMAR SRIVASTAVAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court directed the disciplinary authority to conclude the disciplinary proceedings against the petitioner within three months, without setting aside the original order.

Summary

The petitioner, Dr. Anil Kumar Srivastava, challenged an order dated 09.09.2025 that directed the initiation of a disciplinary enquiry against him. The respondent State argued that a charge-sheet had already been issued and that the matter was proceeding, seeking no interference. The petitioner sought a direction for the disciplinary authority to conclude the proceedings expeditiously. The Court, after hearing counsel, did not set aside the 09.09.2025 order but directed the disciplinary authority to complete the enquiry within three months of the certified copy of the judgment. The Court also emphasized that the petitioner must cooperate and avoid unnecessary adjournments. Consequently, the disciplinary proceedings are to be concluded promptly as per the Court’s directive.

Issues considered

  • What relief, if any, can the High Court grant in a writ petition challenging the initiation of disciplinary proceedings?
  • Whether the Court can direct the disciplinary authority to conclude the enquiry within a specific time-frame without interfering with the original order.
