Allahabad High Court

SHASHIKANT UPADHYAYversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The Court held that there was no basis to interfere with the appointment of the respondent and dismissed the writ petition.

Summary

The petitioner, Shashikant Upadhyay, filed a writ petition challenging the appointment of Manoj Kumar Dixit, who had been serving as a Revenue Assistant for over two decades. The petitioner alleged impropriety in the appointment and sought judicial intervention. The respondent State of U.P. and others contested the petition, arguing that the matter should be addressed by the appropriate administrative authority. After hearing both sides and examining the records, the Court found no merit in the petitioner's complaint that warranted interference with the appointment. Consequently, the Court dismissed the writ petition, directing the Registrar to inform the District Magistrate, Etah of the order. The decision underscores the principle that courts will not intervene in administrative appointments absent clear legal violations.
