AJAB SINGH AND 31 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The petition is disposed without granting mandamus, directing the petitioners to make a fresh representation before the Additional Director General of Police (Establishment).

Summary

Petitioners, a group of police personnel, filed a writ petition seeking mandamus directing the State of U.P. to grant them 2nd and 3rd Additional Compensatory Pay (ACP) after completing 16 and 26 years of satisfactory service, respectively, as per paragraphs 3(1)(KHA) and 3(1)(GA) of a Government Order dated 05.11.2024. They argued that similarly situated officers had already received the benefits through orders dated 08.07.2024 and 06.08.2025. The respondent, represented by the Standing Counsel, contended that the petitioners must first make a fresh representation before the Additional Director General of Police (Establishment) for a decision. The Court, after hearing both sides, declined to entertain the merits and disposed of the petition, directing the petitioners to file fresh representation with requisite documents within three weeks, after which the respondent would decide expeditiously. No substantive order granting the ACPs was made.

Issues considered

  • Whether the petitioners are entitled to 2nd and 3rd Additional Compensatory Pay under the Government Order dated 05.11.2024.
  • Whether a writ of mandamus can be issued directing the State to grant the ACPs without the petitioners first making a fresh representation.
