- Decided
- Bench
- PRAKASH PADIA
Holding
The Court ordered the petitioner to submit a fresh representation to the Inspector General, without deciding the substantive entitlement to promotion.
Summary
The petitioner, Jagdish Prasad, was appointed as a Registration Clerk in 1991 and superannuated on 30 June 2023. He claims entitlement to the Second and Third A.C.P. positions after completing 24 and 26 years of service respectively, and submitted a representation on 24 April 2026 seeking promotion, but no decision was taken. The respondents, the State of U.P. and two others, argued that a fresh representation should be filed before the Inspector General, Registration U.P., Prayagraj, who would then decide the matter promptly. The Court, after hearing counsel, declined to adjudicate the merits and directed the petitioner to file a fresh, detailed representation with supporting documents within three weeks. Upon compliance, the respondent is mandated to decide the case expeditiously, preferably within six weeks, unless a legal impediment exists.

- Whether the petitioner must file a fresh representation before the Inspector General for the matter to be considered

given by the petitioner before the respondents but till date no decison has
been taken in the matter.
2. On the other hand, it is argued by learned Standing Counsel that in
case, the petitioner will submit fresh representation before the respondent
No.2/Inspector General, Registration U.P. Prayagraj, respondent No.2
will take a decision in the matter expeditiously.
4. Heard learned counsel for the parties and perused the record.
