Allahabad High Court

RAMESH CHANDversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that the petition for mandamus should be dismissed and the petitioner must file a fresh representation before the concerned department, which will decide the matter expeditiously.

Summary

The petitioner, Ramesh Chand, filed a writ petition seeking a mandamus directing the State of Uttar Pradesh and related authorities to regularize his appointment as a Fourth Class Employee under the Government Orders of 2016 and 2021 and to pay him salary and benefits. He also requested the court to compel the third respondent, the Additional Director (II) Animal Husbandry Department, Meerut, to decide on a representation he had filed on 6 April 2026. The respondents argued that the petitioner had already made a fresh representation before the concerned department, which would be decided expeditiously. The Court examined the submissions and noted that the pending representation should be addressed by the department without judicial interference. Consequently, the Court dismissed the writ petition, directing the petitioner to submit a fresh representation with a certified copy of the order within three weeks, after which the department must decide the matter within four weeks, barring any legal impediment.

Issues considered

  • Whether the court should issue a mandamus directing regularisation of the petitioner’s services under the Government Orders of 2016 and 2021.
  • Whether the court should compel the third respondent to decide the petitioner’s representation dated 06.04.2026.
