Allahabad High Court

VIPUL SUNDERAMversusZONAL MANAGER, VARANASI ZONAL OFFICE, BANK OF MAHARASTRA AND 2 OTHERS

Decided

Holding

The petition was dismissed without merits, directing the petitioner to submit a fresh, documented representation to the Zonal Manager.

Summary

The petitioner, a senior manager of Bank of Maharashtra, challenged a transfer order dated 18‑04‑2026 that moved him from Gorakhpur Branch to Sahajanwa Branch, alleging that his medical condition prevented him from relocating. He sought to remain in Gorakhpur, either in the same branch or another within the city, without contesting the legality of the transfer itself. The bank contended that the transfer was made under a general administrative order dated 10‑04‑2026 and that the petitioner had not furnished any medical documents to support his claim. The High Court held that the petition could not be entertained in its present form and dismissed it without addressing the merits, directing the petitioner to file a fresh, documented representation before the Zonal Manager. The court further ordered that the transfer order remain in force pending the outcome of the forthcoming representation, which must be decided within 15 days of receipt.

Issues considered

  • Whether a writ petition challenging a bank's administrative transfer order on medical grounds can be entertained without supporting medical documentation.
  • Whether the court should stay the transfer order or direct the petitioner to pursue internal grievance redressal mechanisms.

                    HON'BLE DINESH PATHAK, J.

learned counsel for the respondent nos. 1,2 and 3.

Gorakhpur city. It is, therefore, prayed that, on sympathetic consideration,
the petitioner may be permitted to continue at Gorakhpur city, if not in the
same branch, then in some other branch within the city.

3. Learned counsel for the respondent-Bank submits that the present
petitioner has been transferred on account of administrative exigencies by
the general transfer order dated 10.04.2026, whereby several officers were
proposed to the transferred from their respective place of posting. It is
further submitted that although the petitioner has made a representation
against his transfer order; he has failed to furnish relevant documents in
support of his representation.
