Allahabad High Court

SORAN SINGH AND 4 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is dismissed at the admission stage; petitioners are directed to make fresh representations to the DGP (Establishment) for consideration.

Summary

The petitioners, former Indian Army personnel now serving as constables in the Uttar Pradesh Police, filed a writ petition seeking that their prior army service be considered for benefits under Paragraph‑410 of the U.P. Police Regulations. They alleged that despite repeated representations, the authorities had not acted on their request. The Court, with the parties' consent, disposed of the petition at the admission stage, directing the petitioners to submit fresh representations to the Deputy Inspector General (Establishment) within three weeks, and the respondent to decide within six weeks. The Court emphasized that no merits were adjudicated and the order should not be construed as a substantive ruling on the petitioners' claim. Consequently, the petition was dismissed without prejudice, pending the fresh representation.
