Holding
The order dated 21 November 2025 is quashed.
Summary
Ramesh Singh Siddhu filed a writ petition challenging an order dated 21 November 2025 issued by the Commissioner of Police, Ghaziabad. The petitioner contended that the order was contrary to law, relying on the precedent set in Sachichida Nand Tripathi v. State of U.P. (Writ A No.69308 of 2013). The respondents did not dispute the legal position presented. The High Court, applying the reasoning of the earlier judgment, held that the impugned order was unlawful and quashed it. The court clarified that the quashing does not bar the respondents from initiating fresh proceedings in accordance with the Uttar Pradesh Police Officers of the Subordinate Ranks (Punishment and Appeal) Rules, 1991. The petition was therefore allowed.
Issues considered
- The legality of the order dated 21 November 2025 issued by the Commissioner of Police, Ghaziabad.
- Whether the precedent set in Sachichida Nand Tripathi v. State of U.P. applies to the present order.
