Allahabad High Court

DORI LALversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court disposed of the writ petition, directing the petitioner to file a fresh representation and the respondent authority to decide the claim within two months, thereby acknowledging the petitioner's entitlement under the earlier judgments.

Summary

Dori Lal, a daily wage employee of the Uttar Pradesh Forest Department, filed a writ petition seeking a mandamus directing the State to pay him the minimum wage of Rs 18,000 per month as recommended by the 7th Pay Commission. He alleged that despite several representations and a directive issued by the Principal Chief Forest Conservator in April 2023, no payment had been made. The Court noted a prior judgment in Mohan Swaroop v. State of U.P. that ordered similar payment and observed that orders had been issued by forest officers to pay the amount with arrears from April 2018. While the respondent counsel argued that the petition need not be kept pending, the Court, without deciding the merits, disposed of the petition, directing the petitioner to file a fresh representation within three weeks and the respondent authority to decide it within two months, subject to the applicability of the Supreme Court decision in Sabha Shankar Dube and the Mohan Swaroop judgment.

Issues considered

  • Whether the petitioner is entitled to a mandamus directing payment of the minimum wage of Rs 18,000 per month under the 7th Pay Commission.
  • Whether the prior judgments in Mohan Swaroop (2018) and Sabha Shankar Dube (2018) bind the respondent authorities to make such payment.
  • Whether the writ petition should be dismissed or the petitioner should be directed to pursue a fresh representation before the concerned authority.
