Allahabad High Court

LAXMI NARAYANversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court did not grant a writ of mandamus but disposed of the petition, allowing the petitioner to make a fresh representation and directing the respondent authority to decide the claim within a stipulated period.

Summary

The petitioner, a daily wager in the Uttar Pradesh Forest Department, filed a writ petition seeking a mandamus directing the respondents to pay him the minimum wage of Rs 18,000 per month as recommended by the 7th Pay Commission. He alleged that despite several representations, the department had not paid the amount and cited a prior judgment (Mohan Swaroop v. State of U.P.) ordering such payment. A letter from the Principal Chief Forest Conservator dated 5 April 2023 reiterated the earlier court order and instructed forest officers to comply. The High Court, after noting the prima facie entitlement of the petitioner, declined to issue a mandamus and instead disposed of the petition, granting the petitioner liberty to file a fresh representation within three weeks, after which the respondent authority must decide the grievance within two months. The court also warned that if the petitioner’s claim falls within the scope of the Supreme Court’s decision in Sabha Shankar Dube v. Divisional Forest Officer and the Mohan Swaroop judgment, the minimum pay scale must be paid with arrears from April 2018.

Issues considered

  • What is the petitioner’s entitlement to the minimum wage of Rs 18,000 per month under the 7th Pay Commission and prior judicial pronouncements?
  • Whether a writ of mandamus is the appropriate remedy in the present circumstances?

Subjects

  • minimum wage
