Allahabad High Court

MURARIversusUNION OF INDIA AND 4 OTHERS

Decided

Holding

The petition is dismissed as the appropriate remedy lies with the Central Administrative Bench, Allahabad.

Summary

The petitioner, Murari, filed a writ petition (Writ‑A No. 7489 of 2026) challenging an action of the Union of India and four other respondents. The respondents, through counsel B.K. Singh Raghuvanshi, raised a preliminary objection that the dispute falls within the jurisdiction of the telecommunication department and that the appropriate forum is the Central Administrative Bench, Allahabad. The petitioner did not contest this preliminary objection. The Court accepted the objection as undisputed. Consequently, the High Court held that it lacked jurisdiction to entertain the writ and dismissed the petition. The dismissal was based solely on the procedural ground that the remedy lies before the Central Administrative Bench.
