Holding
The petition is dismissed as infructuous.
Summary
Petitioner Sunita Devi challenged a notice dated 18 March 2024 issued by the Police Commissioner, Varanasi. The petitioner argued that a subsequent decision in another writ (Writ A No.11573 of 2024) rendered the present petition moot. The court examined whether the notice could still be contested in light of the later proceedings. Finding that the later decision effectively resolved the dispute, the court held that the petition had become infructuous. Consequently, the petition was dismissed.
Issues considered
- Whether the notice dated 18.03.2024 issued by the Police Commissioner is open to judicial review
- Whether the petition is infructuous due to the pendency of a fresh decision in Writ A No.11573 of 2024
