The High Court directed the Board of Revenue to decide the pending revision within four months, after hearing all concerned parties.
Summary
The petitioners filed a writ petition seeking a direction to the Uttar Pradesh Board of Revenue, Lucknow, to decide Revision No. 2354 of 2015, which had been pending since 2015 with repeated adjournments. The petitioners argued that the adjournments were not justified under Paragraph 458(2) of the U.P. Revenue Court Manual and that they were the sole contesting respondent who had already filed an objection. The State's standing counsel supported the petition, urging the Board to decide the matter expeditiously in accordance with law. The Court, after hearing counsel, ordered the Board of Revenue to pass an appropriate order after hearing all parties and to decide the revision within four months of receiving a certified copy of the order. Consequently, the petition was disposed with the said direction.
Issues considered
- Whether the Board of Revenue can be directed by the High Court to decide a pending revision within a specified time frame.
