Allahabad High Court

AWADHESHversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The Court held that the respondent must decide the pending revision within six months from receipt of the certified order.

Summary

The petitioner filed a writ petition seeking a direction to the respondent to decide Revision No. 3277 of 2023, which had been pending since 2023 and repeatedly adjourned. The petitioner argued that the delay was unjustified and invoked paragraph 458(2) of the U.P. Revenue Court Manual, which mandates disposal of a revision within six months of filing. The Court examined the petition and found merit in the claim of undue delay. Consequently, the Court ordered the respondent to decide the pending revision within six months from the date a certified copy of the order is presented. The petition was disposed of with the said direction.
