Allahabad High Court

DEVI PRASADversusTHE BOARD OF REVENUE AND 5 OTHERS

Decided

Holding

The High Court directed the Board of Revenue to decide the pending restoration application within three months.

Summary

The petitioner, Devi Prasad, filed a writ petition before the Allahabad High Court seeking a direction to the Board of Revenue to decide Restoration Application No. 130 of 2025 (Ram Sewak v. Smt. Shivpati) which had been pending since 2025 and repeatedly adjourned without justification. The petitioner argued that the delay violated principles of speedy justice and requested the court to fix a reasonable time for disposal. The court examined the petition and found no justification for the continued adjournments. Consequently, the court ordered the respondent to decide the restoration application within three months of receiving a certified copy of the order. The petition was thereafter disposed of with the said direction.
