Allahabad High Court

AMAR BAHADUR AND ANOTHERversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The High Court held that respondent No. 2 must decide the pending case within five months of the order, subject to the absence of any legal impediment.

Summary

The petitioners filed Writ Petition No. 4422 of 2026 before the Allahabad High Court seeking a direction to respondent No. 2 to decide the pending civil suit Rev/383/2016, which has been adjourned since 2016. They alleged that the case was being delayed without justification and invoked Section 333 of the Uttar Pradesh Zila Adalat & Land Revenue Act for expeditious disposal. The standing counsel for the respondents assured that a decision would be taken promptly. After hearing both sides, the Court directed respondent No. 2 to decide the aforesaid case within five months of receipt of a certified copy of the order, provided there is no legal impediment. The writ petition was consequently disposed of with the said direction.

Issues considered

  • Whether the High Court can, under Section 333 of the U.P. Zila Adalat & Land Revenue Act, direct a subordinate authority to decide a pending case within a fixed time‑frame
  • Whether the prolonged adjournments since 2016 constitute an unlawful delay warranting judicial intervention
