Allahabad High Court

SANJEEV AGARWALversusSTATE OF U.P. AND 8 OTHER

Decided

Holding

The High Court directed the Additional Commissioner to decide the pending appeal expeditiously, subject to the absence of any legal impediment.

Summary

The petitioner, Sanjeev Agarwal, filed a writ petition seeking a direction to the Additional Commissioner (Administrative), Agra Division, to decide Appeal No.2020 of 2023 (Computerized Case No.C202301000002020) expeditiously. The petitioner argued that a considerable period had elapsed without a final decision on the appeal. The Court noted that putting the respondents on notice was unnecessary as the order sought was purely procedural. It held that the Court could issue a directive to the administrative authority to dispose of the pending appeal without undue adjournments, provided no legal impediment existed. Consequently, the petition was disposed, directing the respondent to decide the appeal promptly in accordance with law. The Court reserved the respondents' right to seek modification of the order if aggrieved.

  • Whether the petitioner is entitled to such a direction without a detailed hearing of the respondents.

                                                                    Pranjal Mehrotra

                                    Court No. - 6
                                                         HON'BLE PRAKASH PADIA, J.

                                    1. Heard learned counsel for the petitioner, learned Standing
Counsel for the respondent-State and perused the record.

                                    2. In view of the order proposed to be passed herein, no useful
purpose would be served by putting the respondent/respondents to
notice and keeping this petition pending before this Court. However,
in case respondent/respondents feels aggrieved by the order his/her
right to seek modification/variation of the order is being kept reserved.

                                    3. The basic relief sought by the petitioner/petitioners in the present
petition is to direct the respondent no.2-Additional Commissioner
(Administrative), Agra Division, Agra to decide Appeal No.2020 of
                                    2023, Computerized Case No.C202301000002020 expeditiously.

                                    4. It is argued by counsel for the petitioner that though a considerable
time has already been lapsed but till date no final decision has been
                                    taken in the matter.

                                    5. In the facts and circumstances of the case, the present petition is
disposed of directing the court concerned to decide the aforesaid
appeal expeditiously strictly in accordance with law and without
granting unnecessary adjournment unless there is no legal
                                    impediment.
