Allahabad High Court

BEENA SRIVASTAVAversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The Court directed the Naib Tehsildar to decide the recall application within four months, without unnecessary adjournments.

Summary

Beena Srivastava filed a writ petition (WRIT C No.10113 of 2026) seeking a direction to the Naib Tehsildar of Lalganj, District Mirzapur, to decide a pending recall application (RST No.1780 of 2024) that had remained undecided for a considerable period. The petitioner argued that the delay violated her right to a timely administrative decision. The respondents, including the State of Uttar Pradesh, contended that no notice was necessary as the order sought was merely procedural. The Court observed that putting the respondents on notice would serve no useful purpose and that the petitioner’s relief could be granted without further hearing. Consequently, the Court disposed of the petition, directing the Naib Tehsildar to decide the recall application strictly in accordance with law, within four months and without unnecessary adjournments. The order was signed on 18 March 2026 by Justice Prakash Padia.
