Allahabad High Court

SMT. RAMSHREEversusSTATE OF U.P. AND 5 OTHER

Decided

Holding

The Court held that it may direct the administrative authority to decide the pending revision expeditiously, without granting unnecessary adjournments, provided there is no legal impediment.

Summary

Smt. Ramshree filed a writ petition before the Allahabad High Court seeking a direction to the Additional Commissioner (Administrative), Agra Division, to decide Revision No.1925 of 2025 (Computer Case No.C202501000001925) expeditiously. The petitioner argued that despite considerable time lapse, no final decision had been rendered. The Court observed that putting the respondents on notice was unnecessary and reserved the right to modify the order if aggrieved. Consequently, the Court ordered the respondent to decide the revision promptly, in accordance with law, and to refrain from granting unnecessary adjournments unless a legal impediment exists. The petition was disposed with this directive.

                                    Court No. - 6
                                                         HON'BLE PRAKASH PADIA, J.

                                    1. Heard learned counsel for the petitioner, learned Standing
Counsel for the respondent-State and perused the record.

                                    2. In view of the order proposed to be passed herein, no useful
purpose would be served by putting the respondent/respondents to
notice and keeping this petition pending before this Court. However,
in case respondent/respondents feels aggrieved by the order his/her
right to seek modification/variation of the order is being kept reserved.

                                    3. The basic relief sought by the petitioner in the present petition is to
direct the respondent no.2-Additional Commissioner (Administrative),
Agra Division, Agra to decide Revision No.1925 of 2025, Computer
                                    Case No.C202501000001925 expeditiously.

                                    4. It is argued by counsel for the petitioner that though a considerable
time has already been lapsed but till date no final decision has been
                                    taken in the matter.

                                    5. In the facts and circumstances of the case, the present petition is
disposed of directing the respondent no.2 to decide the aforesaid
revision expeditiously strictly in accordance with law and without
granting unnecessary adjournment unless there is no legal
                                    impediment.

                                                                                          (Prakash Padia,J.)
