Allahabad High Court

SHISHIR KUMAR SRIVASTAVAversusCENTRAL BANK OF INDIA

Decided

Holding

The Court held that the writ petition should be disposed of and the petitioner must file a fresh representation before the bank.

Summary

The petitioner, Shishir Kumar Srivastava, filed a writ petition seeking a direction from the Central Bank of India to furnish the rent due for Locker No. 144 and to permit him to operate the locker with Key No. 70. The petitioner alleged that the bank had not released the locker rent and was obstructing his access. The bank opposed the petition. The Court, without delving into the merits, dismissed the writ and instructed the petitioner to file a fresh representation, along with a certified copy of this order, to the bank within one month. The bank was directed to consider and decide on that representation within one month of receipt. The order thus provides a procedural remedy rather than a substantive ruling on the locker dispute.
