Allahabad High Court
SMT. GEETANJALI AND 16 OTHERSversusTHE STATE OF U.P. AND 4 OTHERS
- Decided
Holding
A writ petition filed jointly by multiple petitioners, each having a separate cause of action, is not maintainable.
Summary
The petitioners, a group of four industrial plot allottees, filed a writ petition seeking a mandamus directing the State to grant a six‑month relaxation for operating their industrial units without penalty, as extended in government orders during the COVID‑19 period. They also sought relaxation for plots allotted during the pandemic. The Court observed that each petitioner had a separate cause of action and that a single petition on behalf of all four was not maintainable. Consequently, the petition was dismissed for lack of maintainability. The Court, however, granted liberty to each petitioner to file individual writ petitions. No substantive merits on the relaxation request were addressed.
