Allahabad High Court
RAJESH SINGHversusUNION OF INDIA AND 3 OTHERS
- Decided
Holding
The petition is disposed of, with the petitioner directed to file a fresh representation and the railway authority mandated to decide it within a month.
Summary
The petitioner, Rajesh Singh, was awarded a three‑year lease to operate a three‑wheeler parking facility at Azamgarh Railway Station, but the railway authority subsequently took possession of the area without providing an alternative space. The petitioner filed a writ petition alleging denial of his contractual rights and sought relief. The respondents argued that the petition should be dismissed and that the petitioner should approach the authority with a fresh representation. The High Court, without delving into the merits, directed the petitioner to file a fresh representation, attaching a certified copy of the order, within one month, and instructed the Divisional Railway Manager to decide the representation within one month of receipt. Consequently, the writ petition was disposed of, with the court emphasizing procedural compliance over substantive adjudication.

HON'BLE GARIMA PRASHAD, J.
1. Heard learned counsel for the petitioner and the learned counsel for the
respondents.
2. The grievance of the petitioner is that he has been granted contract
(lease) for parking of three wheelers at Azamgarh Station for three years
w.e.f. 16.12.2024 to 15.12.2027. He has been depositing the licence fee.
The respondent authority has now taken possession of the parking area
without providing any proper parking area to the petitioner. In this regard,
petitioner has moved several applications before the authority concerned,
however till date no action has been taken on the same.
3. Learned counsel for the respondent submits that no useful purpose
would be served in keeping the writ petition pending and appropriate
direction may be issued to the respondent-authority to consider the
grievance of the petitioners.
4. Considering the facts and circumstances of the case and without
adverting into the merits of the case, we dispose off the writ petition
permitting the petitioner to file a fresh representation alongwith certified
