Allahabad High Court

LAVKUSH KUSHWAHAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court directed the District Magistrate to decide the pending compensation application within one month, without granting unnecessary adjournments.

Summary

The petitioner, Lavkush Kushwaha, filed a writ petition seeking a direction to the District Magistrate of Kushinagar to decide his pending application for compensation under the Mukhyamantri Krishak Durghatna Kalyan Yojna. The respondents, the State of U.P. and another, opposed the petition. The learned Standing Counsel argued that keeping the petition pending would serve no useful purpose and that the magistrate should be directed to consider the grievance. The Court, without examining the merits of the compensation claim, ordered that the District Magistrate decide the application expeditiously, preferably within one month of the certified copy of the order, and not grant unnecessary adjournments. Consequently, the writ petition was disposed of with the said direction.
