Allahabad High Court

GULAM YAZ DANI KHANversusUNION OF INDIA AND ANOTHER

Decided

Holding

The court held that, given the petitioner’s acquittal, he may file a representation to the Regional Passport Officer, who must decide the passport hold within a month.

Summary

The petitioner, Gulam Yaz Dani Khan, filed a writ petition challenging the passport authority's order that placed his passport on hold. He argued that he had been acquitted in criminal case No.1377 of 2018 and that no criminal proceedings were pending against him, making the hold illegal. The court examined the record and confirmed the acquittal. It directed the petitioner to submit a detailed representation to the Regional Passport Officer within one month, and ordered the officer to consider and decide the matter within another month. The writ petition was therefore disposed, allowing the representation process to proceed.
