Allahabad High Court

SMT. VANDANA SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court ordered the petitioner to file a fresh representation with a certified copy of the order and directed the District Magistrate to decide the matter within one month.

Summary

The petitioner, Smt. Vandana Singh, filed an application for compensation under the Mukhyamantri Krishak Durghatna Kalyan Yojna on 12 March 2026, which remains pending before the District Magistrate, Prayagraj. She approached the High Court seeking a direction that the competent authority decide her grievance. The respondents argued that the matter could be considered by the competent authority without court intervention. The Court, without examining the merits, disposed of the writ petition and permitted the petitioner to file a fresh representation, attaching a certified copy of the order, within one month. The Court further directed the District Magistrate to consider and decide the representation within one month of receipt. The order thus provides a procedural remedy while leaving the substantive claim to be adjudicated by the administrative authority.

Issues considered

  • Whether a High Court can direct a District Magistrate to consider a pending compensation application under the Mukhyamantri Krishak Durghatna Kalyan Yojna.
  • Whether the petitioner should be allowed to file a fresh representation with a certified copy of the court order.

                                    1. Learned counsel for the petitioner at the outset submits that the subject
matter of the present writ petition is pending consideration before the
respondent no.2-District Magistrate, Prayagraj by way of an application for
compensation under the Mukhyamantri Krishak Durghatna Kalyan Yojna,

                                    2. Per contra, learned Standing Counsel for the respondents contends that
the matter can very well be considered by the competent authority and
therefore, an appropriate direction be issued to the competent authority to
consider the grievance of the petitioner.
