Allahabad High Court

BRIJESH KUMARversusSTATE OF U.P. AND 7 OTHERS

Decided

Holding

The court held that the respondents must not construct the chakroad over the petitioner's land covered by Gata No. 664.

Summary

The petitioner, Brijesh Kumar, filed a writ petition alleging that the State and other respondents had marked his agricultural land (Gata No. 664) for the construction of a chakroad, which he contended should be laid in the adjoining Gata No. 641. The petitioner claimed that his land was under cultivation and that no road work had been authorized there. The respondents, through written instructions from the Block Development Officer, asserted that no chakroad had been constructed in Gata No. 664, that the land was currently sown with paddy, and that the road was not part of any work plan. After considering the submissions and the stand taken by the respondents, the High Court directed that no chakroad be constructed over the petitioner's land in Gata No. 664 and that any future work by the Gaon Sabha must ensure the petitioner's holdings are not adversely affected. The petition was consequently disposed with the said direction.

Issues considered

  • Whether the respondents are authorized to construct a chakroad over the petitioner's land covered by Gata No. 664.
  • Whether the petitioner's grievance merits relief in the form of a direction restraining construction.
