Allahabad High Court

DEO NARAYAN AND ANOTHERversusSTATE OF U.P. AND 10 OTHERS

Decided

Holding

The Court directed the Additional District Magistrate to decide the pending case within four months, thereby granting the writ of mandamus.

Summary

Petitioner Deo Narayan and another filed a writ petition seeking a mandamus directing the Additional District Magistrate, Finance and Revenue, Tehsil Naugarh, to decide a pending case (Case No. 1383 of 2025) filed under Section 198(4) of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950. The petition argued that the case had been pending since 19 August 2025 and required expeditious disposal. The State's standing counsel raised no objection to the direction. The High Court held that the court could issue a mandamus to ensure timely adjudication and ordered the magistrate to decide the pending case within four months of the certified copy of the order, without unnecessary adjournments. The petition was disposed with the direction granted.

Issues considered

  • Whether a writ of mandamus can be issued directing an administrative authority to decide a pending case under Section 198(4) of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950.
  • Whether the delay in deciding the pending case warrants judicial intervention.
